What is Section 16A of the Income Tax Act?

• Income Exempt from Indian Tax Laws: TDS deduction under Section 16A is not necessary if the income earned by an NRI is specifically exempt from the Indian Income Tax, such as life insurance maturity benefits under Section 10(10D). Such payments can be remitted in full without TDS deduction.
• Lower or Nil TDS Certificate from Income Tax Department: A non-resident can request the Income Tax Department to issue a certificate for a lower or zero TDS rate, usually based on DTAA benefits or available exemptions. Once this certificate is provided, the payer is required to deduct TDS only at the rate mentioned in it.
• Payments Below the Prescribed Threshold Limit: TDS under Section 16A may not be required if the total payment made to a non-resident does not exceed the prescribed threshold limit for the financial year. It is important to verify the applicable threshold limit by consulting a tax expert.

Taxpayers should comply with the provisions under Section 16A of the Income Tax Act, 1961, to ensure effective tax compliance. The below mentioned steps can help ensure that you stay tax compliant under 16A section provisions:

• Step 1: Identify the Payee’s Residential Status
  
  Confirm that the recipient is a Non-Resident or a foreign company as defined under the Income Tax Act, 1961, before making any payment. If the recipient is a resident tax payer, Section 16A is not applicable. In this case, a different TDS provision may apply depending on the nature of the payment.
• Step 2: Categorise the Type of Income Received
  
  Before making the payment, check the nature of income. Key categories include - royalty, fees for technical services (FTS), professional fees, contractual payments, interest, or other income. Classifying the nature of income will determine the applicable TDS rate.
• Step 3: Check for an Applicable DTAA
  
  Check if the Indian Government has entered into a Double Taxation Avoidance Agreement (DTAA) with the NRI's country of residence. If the DTAA is applicable, request the NRI to provide a Tax Residency Certificate (TRC). Thus, the reduced DTAA rate is applicable only when the NRI submits a valid TRC.
• Step 4: Apply for a Lower or Nil TDS Certificate if Eligible
  
  The non-resident individual can apply to the Income Tax Department for a lower or nil TDS certificate before the payment if the income earned in India is exempt under the Income Tax Act, such as Section 10(10D) or if a DTAA is applicable to lower the TDS rate.
• Step 5: Deduct TDS at the Applicable Rate
  
  The TDS calculation on the gross payment made to the NRI at the statutory default TDS rate or DTAA reduced rate can be done now. The TDS should be deducted before remitting the net amount to the NRI. Thus, the deduction should be made at the time of payment or at the time of credit to the payee’s account, whichever is earlier.
• Step 6: Deposit TDS with the Government
  
  Deposit the deducted TDS online using Challan 281 through the Income Tax e-filing portal by the 7th of the next month (for March, the due date is 30th April). In case of delayed payment interest will be charged at 1.5% per month on the due amount.
• Step 7: File Form 27Q and Issue Form 16A
  
  File the TDS return by the 15th of the month subsequent to the end of the quarter in which the payment was made. using Form 27Q. This TDS form is meant for payments made to non-residents or foreign companies. Once filed, download Form 16A (TDS certificate) from TRACES and provide it to the non-resident within 15 days from the due date of filing the return.

Under Section 16A, deducting TDS on time, depositing it, filing Form 27Q, and issuing Form 16A are all separate responsibilities. Each steps has its own deadline and penalty rules. If you fail to comply with any of these in a timely manner, various penalties may apply.
