IRDAI Regulations and Investor Protection

  • Insurance companies are mandated to provide all the relevant information to the policyholder about different charges for each policy year.

  • Benefit illustrations are to be provided by the insurers in two scenarios of interest at 4% and 8%. Additionally, the policyholders are required to sign the illustration and proposal.

  • The lock-in period of ULIP policy has been increased from three years to five years for long-term financial protection.

  • All ULIP premiums, regular and limited, should be uniform.

  • Additional payment towards the ULIP should be treated as a single premium for insurance cover. Moreover, charges should be evenly distributed over the five-year lock-in period to avoid excessive front-end expenditure.

  • A ULIP policy with a limited premium should have a paying term of at least five years.

  • All unit-linked insurance plans (ULIPs) other than pension and annuity plans should include a mortality or health cover. Moreover, the minimum cover under these segments is to be specified by the insurance company.

  • To relax the policyholder's charge structure, a premium cap is imposed from the 5th year.

IRDAI has released new regulations to prevent policyholders from being overcharged when discontinuing or surrendering ULIP policies. They include the following provisions

  • The insurance company shall recover only the incurred acquisition costs, which should not be excessive.

  • If the costs are found to be excessive on enquiry, then IRDAI can order a refund of discontinuance charges.

  • Discontinuance charges are limited to a percentage of the fund value and the premium.

  • If a policyholder is discontinuing a policy, they have the right to revive it or withdraw from it without any risk cover.

  • The insurance company must specify the grace period for different premium payment modes to ensure transparency.

Solvency Ratios and Fund Segregation

Solvency ratio is a measurement used to assess an insurer's capacity to fulfil its obligations and responsibilities. It refers to the financial resources available in the insurance company to meet its commitments.

The Insurance Regulatory and Development Authority of India (IRDAI) requires insurance companies to maintain a solvency ratio of 1.5 times. When buying a ULIP policy, it is essential to check the solvency ratio to minimise risk.

Critical Illness and Disability Rider variant opted is Platinum Plus which covers 64 critical Illnesses.
